1. Acceptance of Terms
1.1. By visiting, using, or making a purchase on the My CDL Practice Test website, you enter into a legally binding agreement with Elfalogix. These Terms and Conditions govern your access to and use of our platform and all related services.
1.2. If you do not agree with any part of these Terms, please discontinue use of the Site immediately. Continued use of the Site confirms your acceptance of these Terms in full.
1.3. You must be at least 13 years of age to use this Site. Users under the age of 18 may only access the Site with the knowledge and consent of a parent or legal guardian. Any purchases made on behalf of a minor must be authorized and completed by a parent or legal guardian.
2. Consumer Protection
2.1. Nothing in these Terms is designed to override, limit, or remove any rights you may hold under applicable consumer protection laws in the United States or your state of residence.
2.2. Where any provision of these Terms conflicts with a right that cannot be legally waived, that right remains in full effect. Any optional warranties or conditions not required by law are excluded to the fullest extent permitted.
3. Intellectual Property
3.1. My CDL Practice Test is an independent study platform created for educational purposes only. We are not affiliated with, endorsed by, or connected to any DMV office, state agency, or government body in the United States.
3.2. All original content on this Site, including but not limited to cheat sheets, study materials, layout, design, software, and user interface elements, is the intellectual property of Elfalogix or its licensors and is protected under applicable intellectual property laws.
3.3. Upon purchase, you are granted a limited, personal, non-transferable, and revocable license to access our materials solely for your own private, non-commercial study purposes.
3.4. The following actions are strictly prohibited: reproducing, distributing, or reselling any Site content; sharing account credentials with others; scraping or extracting data from the Site; attempting to reverse engineer any part of our platform; and any activity that disrupts or compromises the security or performance of the Site.
4. Money-Back Guarantee
4.1. We offer a conditional 100% Money-Back Guarantee to users who purchase an eligible product and do not pass their official CDL written knowledge test. The refund is limited strictly to the amount paid to Elfalogix and does not cover any government fees, booking costs, or other third-party expenses.
4.2. To qualify, all of the following conditions must be met:
- Purchase Timing: The eligible product must be purchased at least 14 days before your official test date.
- Study Completion: You must fully complete all available study materials for your state, as confirmed by your account activity logs.
- Performance Requirement: You must achieve a minimum score of 90% on the platform’s final readiness assessment before sitting your official test.
- Proof of Failure: You must provide official documentation confirming you did not pass your CDL written test, including the test date and result.
- Claim Deadline: Your refund request must be submitted to support@mycdlpracticetest.com within 30 days of your failed test date.
4.3. Refund claims will not be accepted if the above conditions are not fully satisfied, if the test appointment was missed, if failure was due to administrative issues such as missing identification, or if account misuse such as credential sharing is detected.
5. Payments and Refunds
5.1. Our products are available on a one-time purchase basis unless stated otherwise at checkout. All applicable prices and taxes are displayed before payment is completed. Payments are securely processed through third-party providers such as Stripe or PayPal. We do not store your full payment card details.
5.2. Where a product has a significant failure under applicable consumer law, you may be entitled to a remedy including a refund or replacement access.
5.3. Outside of valid legal claims or the Money-Back Guarantee outlined in Section 4, refunds for change of mind are not provided once access to the purchased material has been granted.
6. Account Use and Conduct
6.1. Your account is for your personal use only. Sharing your login credentials, allowing others to access your account, reselling access, or transferring your account to another person is a serious breach of these Terms.
6.2. We reserve the right to suspend or terminate accounts where misuse is detected, including simultaneous logins from multiple locations, unusual IP activity, or use of tools designed to mask access patterns. Termination for breach may occur without a refund where permitted by law.
6.3. If you submit any content to the Site such as reviews or feedback, you confirm that it does not infringe any third-party rights and does not contain unlawful, misleading, or harmful material. By submitting content, you grant Elfalogix permission to display and use it in connection with operating and improving the platform.
7. Governing Law & Jurisdiction
7.1. These Terms are governed by the laws of the United States of America. Depending on your state of residence, relevant state laws may also apply where legally required.
7.2. Any dispute arising from or related to these Terms or your use of the Site must be resolved in a court of competent jurisdiction within the United States, unless applicable law requires otherwise.
7.3. If any provision of these Terms is found to be unenforceable in a particular jurisdiction, the remaining provisions continue to apply in full.
8. Limitation of Liability
8.1. To the fullest extent permitted by law, Elfalogix is not responsible for any indirect, incidental, or consequential losses arising from your use of this Site, including but not limited to loss of data, lost profits, missed opportunities, or failure to pass an official CDL written test.
8.2. All cheat sheets and study materials are provided for educational purposes only. We do not guarantee that our content is completely error-free, that access will always be uninterrupted, or that use of our materials will result in passing an official exam.
8.3. Where liability cannot be fully excluded under applicable law, our total liability for any claim related to these Terms is limited to the amount you paid for the specific product giving rise to that claim.
9. Changes to These Terms
9.1. We may update these Terms at any time without prior notice. Any changes take effect immediately upon being published on the Site. Your continued use of the Site after an update confirms your acceptance of the revised Terms. We encourage you to review this page periodically.
